Delta Software Inc. / Delta Waste Systems / Delta Software, hereinafter referred to as Delta Software. The Delta Software (the Software) that accompanies this license is the property of Delta Software Inc. (the Company) and is protected by copyright law. While the Company continues to own the Software, you have certain rights to use the Software. Your use of the software is your acceptance of this license. NOTE: The use of Delta Software on your computer constitutes acceptance of the terms and conditions of this license. The rights to usage of the Software have been granted to you by virtue of this agreement with the Company for the original Location (License Site) where the Software has been installed. The rights also extend to any other single Location to which the Software may be transferred in lieu of the original Location. The Company warrants that: 1. The media on which Delta Software is distributed will be free from defects. 2. The Software contained on the media will be free of errors in its distributed code. Your sole remedy in the event of a breach of this warranty will be that the Company will replace any defective media and or correct any Delta Software errors for a period of 1 year from the original date of delivery of the Software to you. The Company does not warranty that the Software will meet your requirements and the Company makes no other expressed or implied warranty including merchantability, fitness for any purpose or non-infringement of patents, copyrights, or other proprietary rights of others. REGARDLESS OF WHETHER ANY REMEDY SET FORTH HEREIN FAILS OF ITS ESSENTIAL PURPOSE, IN NO EVENT WILL THE COMPANY BE LIABLE TO YOU FOR ANY SPECIAL, CONSEQUENTIAL, INDIRECT OR SIMILAR DAMAGES, INCLUDING ANY LOST PROFITS OR LOST DATA ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. In the event that the ownership of your company is relinquished, sold or in any other way transferred to another party, a new license must be obtained from Delta Software, Inc. by the new ownership for continued usage of the software. Additional copies of the Delta Software can be made available by negotiation with Delta Equipment Systems, Inc. where copies of the software are going to be placed in operation at more than one location, for use by the purchasing company only. This agreement also specifically prohibits the copying, modifying, or reverse engineering of the Delta Waste System by any person or entity for any purpose. All rights reserved. Delta Software is protected Under the US Copyright Law. No part of tis software may be reproduced or distributed or stored in a retrieval system or transmitted in or by any form or any means. Electronic photocopying, recording or otherwise without the written permission of Delta Software.
